WHAT IS A TEILUNGSERKLÄRUNG?
The Teilungserklärung, or declaration of division, divides a building into individual units under the German Condominium Act (Wohnungseigentumsgesetz). It defines separate ownership, common property and co-ownership shares and is entered in the land register.
HOW IT WORKS.
The owner makes the declaration before a notary. It includes a division plan and a certificate of self-containment (Abgeschlossenheitsbescheinigung) from the building authority. Each unit then receives its own land register folio and can be sold individually.
WHY IT MATTERS.
A divided building can be sold unit by unit, an undivided one only as a whole. In some areas, division requires approval. Whether division pays off depends on location, tenants and market.
